Right to deny neighbor access for private renovation in andelsbolig Question: I need legal advice about my rights as an andelshaver. My upstairs neighbors are renovating their bathroom to install a separate shower. This is their private choice, not an emergency repair. Their work has already damaged my apartment: Objects fell from shelves due to vibrations My 4-year-old child stepped on broken glass Oily water leaked into my apartment My bathroom ceiling lamp is now flickering They now want access to my apartment to do pipe work in my ceiling to complete their renovation. I do not consent. The board has pressured me to allow access, even though our current bylaws do not require it. One board member who pushed for this is resigning. At the upcoming general assembly, the board has proposed a bylaw change that would force neighbors to give access for any type of renovation—not just pipe work. My questions: Under current Danish law and andelsbolig rules, can I legally deny my neighbors access to my private apartment for their private improvement project, especially after they have already caused damages and safety risks to my child? Can the board legally pass a rule forcing neighbors to give access for any renovation, without including protections for the affected neighbor (liability for damages, compensation for disruption, safety guarantees)? How do I stop the harassment? The board member has pressured me, and I fear they will continue. What are my rights to be left alone in my home?

Du kan ikke nægte din overbo adgang til din lejlighed, hvis adgang er nødvendig for, at overboen kan renovere sin lejlighed. Det gælder, uanset om vedtægterne indeholder eksplicitte regler herom eller ej. Du har dog ret til at blive varslet i god tid, lige som din overbo skal kompensere dig behørigt, hvis der laves skade i din lejlighed.
Bestyrelsen kan som udgangspunkt ikke vedtage regler for foreningen, men bestyrelsen kan stille forslag om ændring af reglerne, som kan vedtages af generalforsamlingen. Der kan sagtes vedtages regler om naboers adgang til andres lejligheder under renovering.
Umiddelbart mener jeg ikke, at der er tale om chikane. Det opleves muligvis sådan af dig, fordi renoveringen er forbundet med gener. Desværre har man som andelshaver ret til at renovere sin lejlighed, og i sådan en situation må de andre andelshavere tåle diverse, uundgåelige gener i den forbindelse. Heldigvis er renoveringen kun midlertidig, så generne vil snart stoppe.
